Terms and Condition

These terms and conditions are applicable to the use of the website https://carlaganacademy.com and the services provided Online and Offline at different locations by Carlagan Academy & Foundation. Carlagan Academy & Foundation is also referred to as the 'Academy', 'we' or 'us'.

The learner/Student can be referred to as 'you', 'learner', 'student', 'user' and can be any individual (above 18 years) or organisation using the website and/or the services of the Academy or of any 3rd party arrangement which the Academy has be it Online or otherwise. It can also imply a legal guardian of anyone below 18 years of age who is allowing his minor ward to use the same.

The terms Teacher/Trainer/Instructor would mean anyone or any organisation nominated/appointed by the Academy interacting with the Learner directly for teaching or indirectly through recorded content or for providing any Educational related services including Consultancy, Tests, Conducting & Coordination of Events.

By using the website of and/or Services of the Academy you agree and confirm that you have read, understood the Terms and Conditions and agree to be bound by them.

1. Admission

Admission for Courses/Classes/Tests online and/or in Physical mode is at the sole discretion of the academy.

2. Privacy Policy

Student/Learner Details

All learners/students should give correct details. Students/Learners must be at least 18 years of age to enrol in Carlagan Academy and use the Services. For a Student/Learner/User below 18 years of age a parent/legal guardian take full responsibility to adhering to terms of the Academy (attendance, usage, discipline, payment etc.,) and should fill in the Application on behalf of his ward/child. A student/Learner will not be allowed to continue if after admission it is found that any of the details given are incorrect. No refund or adjustment or transfer to any other learner/course will be allowed in such cases.

Information about you is obtained automatically when you use our website or given by you when asked for or when you fill in an application form or make payment or use any 3rd party's services. Some information we have access to (name/age/phone/email/address/qualifications/present work or Study/institution details/IP address etc.,). Some information is made available by you to the Payment Processor used by the Academy to receive payment (the payment gateway/Bank/)(Account Number/credit/debit card details).

We may use the personal information provided by you to communicate with you regarding your present course/class/event/service in progress or for any other future or proposed services or offers by the Academy and by reading and agreeing to the terms of this privacy policy it is deemed that we have your explicit permission to do so.

When you use the services of or visit any website of any 3rd party associated with the Academy or use Payment Processors (banks/Payment Gateways) their privacy policies should be read and understood and you will be governed by them for such usage.

We may disclose any personal information we have received from you only if required by law or if there is any violation of terms on your part.

We reserve the right to make additions/modifications/alterations to this privacy policy and other terms at any time and will take effect from the time of being posted on the Academy's website.

Cookies are used to facilitate use of our website and other 3rd party websites associated with the Academy.

The personal information provided by you is kept confidential and we ensure with our best efforts that it is kept secure and for use by us and 3rd parties associated with us in our communication with you and to provide you with access to our courses/content and other services. We will not share or disclose or transfer any personal information to others.

The user accepts to permit the Academy to send messages, information and promotional material to him/her by call over phone and by SMS, WhatsApp, email, and other modes and this right of the Academy prevails/supersedes the registry of NDNC & DND as per TRAI regulations under the guidelines of TCCPR.

The user is expected to provide information as required for the smooth flow of services to the user and is advised against providing any other information to a Teacher/Trainer/Instructor or any 3rd party associated with the Academy to provide services.

3. Mode of Classes/Courses/Events

All will generally be ONLINE in Synchronous and/or Asynchronous mode except where the Physical Mode is expressly agreed upon.

4. Payment of Fees

Payment of fees should be as instructed:

• Payments for Classes, Tests, Courses, Viewing Content and accessing exercises should be done in advance and to the accounts of Carlagan Academy or to accounts as may be nominated by Carlagan Academy. Payment to Carlagan Academy should be online or by cash in to the Bank Account of Carlagan Academy or through the Payment Gateway (Razorpay or other)
• Payment in advance for certain fixed hours of Classes at an hourly rate within a specified Time Duration (Use by Date)
• Payment for Course (with a Use by Date) OR
• Payment for viewing content/accessing exercises/ for a specified duration (Use by Date) from admission/receipt of payment OR
• Payment for any Test which may be taken Online OR
• Payment for Conduct of an Event OR
• Payment for Consultancy (hourly or as agreed) or any Professional Service related to Education, Training and related Events/Activities
• Proof of Payment is to be sent by email/WhatsApp to Carlagan Academy
• Payments for any other services related to Education or otherwise should be done as instructed by email/WhatsApp by Carlagan Academy

5. Refund Policy

There will be refund (and that too for hours not completed) only if the Teacher/Trainer is unable to complete the scheduled hours for personal or official reasons and if a Replacement Teacher/Trainer is not appointed.

If a proposed Course for which fees have been collected is not commenced within a reasonable time after the scheduled date then the fees collected will be refunded. Sometimes an alternative schedule can be suggested by the Academy and confirmed by the Student in which case there will be no refund.

Any double payment received erroneously brought to the notice of the Academy by the user will be refunded or kept in credit to be adjusted in the future (maximum time 1 month).

A Student's lack of application/sincerity in learning or disturbing the other learners can prevent him/her from being allowed to continue. Refund in such cases will be at the discretion of Carlagan Academy.

In case of discontinuation of Classes by the Academy the proportionate fees (already paid) will be adjusted for classes held up to the time of discontinuation and balance refunded to the user/student.

6. Interruptions & Discontinuation

It may happen that the Online/Web based services of the Academy or of 3rd Parties associated with the Academy are not available sometimes for any planned maintenance or any other breakdown/problem/security and/or other issues including sickness, termination of or non availability of Teacher/Trainer/Instructor and you agree that this will not be held against us legally or otherwise.

It may happen that some features and/or services may be discontinued by the Academy at any time without disclosing any reason and the Academy or 3rd parties associated with the Academy will not be held liable for such discontinuation.

The Academy will not be responsible or held liable for any failure or impairment to our services due to factors beyond our reasonable control like natural disasters, sabotage etc., including power and internet failures.

7. Teacher/Trainer/Instructor

Classes may be assigned to any Teacher/Trainer nominated by Carlagan Academy and if necessitated be subsequently assigned to other Teachers/Trainers. As Teachers/Trainers maintain a record of portions done continuity will be maintained.

All interactions of the user with the Teacher/Trainer/Instructor should be Professional and any deviation should be brought to the notice of the Academy by the user. The Academy is not liable for any claims, loss, any injuries, damages, that might occur due to or in relation to the interactions between the Teachers/Instructors and the Students.

8. Content on Website and Notes, Live Lessons

Maintaining notebooks and taking notes as instructed is advised. Any notes, study material, links to videos, access to website with individual logins given by Carlagan Academy should be used solely by the concerned Student/Learner and should not be circulated.

The content on the Academy's website and during live classes and content accessed through links provided by the Academy have not been reviewed or edited for confirmation of legality. The Academy also does not guarantee that the content is accurate, reliable and valid and the user accesses the content at his/her own risk. The Academy is not responsible or liable if any content is found objectionable, harmful, offensive or indecent to the user. The Academy is also not liable for any loss, harm, bodily injury, claim, damage etc. arising out of using/following the Content available on the website and live classes before, during or after accessing Content.

9. Correction

Excepting Correction of work given in Class any other help in homework or Correction of School/College work/assignments will be done during Class if its on a 1 to 1 basis or by a separate session (minimum Half/hour and payment will be on pro-rata basis of hourly rate) if on 1 on 1 basis or if it's a Group Class.

10. Absence & Late Coming

Classes are scheduled in advance. If a Student/Learner misses a class or is late to class then the Student/Learner will have to catch-up by himself with lessons/grammar taught or by special arrangement with the concerned Teacher/Trainers at a special hourly rate (higher rate) and at times convenient to the Teacher/Trainer. A different Teacher/Trainer may be arranged for such special arrangement. No adjustment of fees for missed classes will be allowed.

If its on a 1 to 1 basis then notice of absence should be done at least 24 hours in advance and this can be done only once in 10 hours and such absence will not be counted. A replacement class will be scheduled as per days/times already fixed or as per concerned Teacher/Trainers availability or as per the availability of a Replacement Teacher.

For an Online Class If a Student is late up to 15 minutes or more for a 1 to 1 Class of 1 or more hours then the class will end as originally scheduled. After 15 minutes the Teacher can logoff and treat the Class as cancelled without notice by the Student. Such Cancelled Classes will be taken into account and charged for as applicable just like an absence without notice.

11. Recording

Recording of classes and any other ONLINE or LIVE Sessions should not be done. Carlagan Academy may however for Training Purposes and as for records or for Promotional Purposes record live classes in audio and/or video/image/document formats. Screenshots or photos can be taken only with the permission of Carlagan Academy.

12. Login IDs and Passwords

Any login/user id and password given to you is for your exclusive use for accessing content and should be kept confidential. The sharing of id and password by a user with another person is not permitted and may lead to termination of services being provided to the user without any refund or recourse to any claim.

The user is to bring to notice to the Academy of any suspected unauthorised use of the login/user ids and password provided to the user and in such cases the user agrees to cooperate with the Academy to investigate such unauthorised usage.

The Academy will not be held liable for any claims that may arise out of misuse of the user id/password due to your failure to keep the same confidential and secure.

13. Indemnification

If the user acts in any manner detrimental to the Academy or commits acts that cause legal action against us the user agrees to indemnify, defend us (and all associated with us providing services) against any 3rd party claims, demands, losses, expenses including attorney fees caused by such acts. Such obligation to indemnify us will continue even after the termination of the agreement between the Academy and User.

14. Reservation of Rights

Discontinuation

Carlagan Academy reserves the right to discontinue classes at anytime for any individual Student or for any Group of Students in which case proportionate fees (already paid) will be adjusted for classes held up to the time of discontinuation and balance refunded.

Rescheduling/Postponement

Classes may be rescheduled/postponed (extended to same time/day schedules) by Carlagan Academy in necessitated circumstances and will in such cases be communicated to the concerned students/learners.

15. Website: Web Based Courses/Content - Use By Date

The web based Courses on either on Self Study or Hybrid mode (self-study + Live online(doubt Clearing) will be based on a 'Use By Date' framework. The course will have to be completed within the time-frames indicated. Any extension of the 'Use by Date' will be allowed on a case by case basis at rates decided by Carlagan Academy.

Even for live Online Classes on an hourly basis or for a full course the use by date will be applicable. Any 'Use by Date' condition as expressly mentioned will be applicable.

Any extension/change in use by date should be communicated by the Academy by email.

16. Third Party Web Based Content/Courses/Tests

For any third party content/Courses/Tests hosted or linked through our Website the terms and conditions of that third party will apply.

However if any related Term or Condition of Carlagan Academy is stricter/more favourable to Carlagan Academy in definition/degree/unit/application/restriction/limitation in comparison with the Term or Condition of such 3rd party then such term of Carlagan Academy will prevail. (infringes on the terms and conditions of Carlagan Academy)

17. Disputes

All disputes will be settled preferably amicably in the best interests of Carlagan Academy and the Students/Learners and if not so settled will fall under the jurisdiction of Chennai City Civil Courts only.
